Product Warranty

Subject to the exclusions contained herein, MDX ELECTRONICS, LLC. warrants that our products are manufactured to be free from defects in material or workmanship under normal use for the time indicated in this section.

What will MDX ELECTRONICS, LLC. do?

MDX ELECTRONICS, LLC. or its authorized dealer at its discretion and within a reasonable commercial time, will repair free of charge or replace any product or accessory that complies with this warranty. We may use functionally equivalent products, accessories, or parts that are refurbished/refurbished/previously owned or new.

What other limitations are there?

Any implied warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose, shall be limited to the duration of this limited warranty, otherwise, the repair or replacement provided under this express limited warranty is the exclusive remedy of the consumer, and is given in lieu of all other warranties, expressed or implied. In no event shall MDX Electronics, LLC or our brands, be liable, whether in contract or tort (including negligence) for damages in excess of the purchase price of the product, or any indirect, incidental, special or consequential damages of any kind, or lost profits, lost profits, loss of data, software or application information or other financial loss arising out of or related to the ability or inability to use products, accessories, or software to the fullest extent that such damages may be waived by law.

Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or the limitation or exclusion of an implied warranty, so the above limitations or exclusions may not apply to you. These rights vary from state to state or jurisdiction to jurisdiction.

Covered Products and Their Duration of Coverage

Cordless and corded telephones: One (1) year from the date of the original consumer purchase of the product.

Consumer Products to be Repaired or Replaced: The balance of the original warranty or for ninety (90) days from the date the consumer made the return, whichever comes first.

Exclusions

Natural wear and tear

Maintenance, repair and replacement of parts due to natural wear and tear are not covered.

Abuse and misuse

Defects or damage resulting from: (a) use, operation, improper or unreasonable storage, misuse or abuse, accident or negligence or other external cause, such as physical damage (fissures, scratches, etc.) to the surface of the product as a result of misuse; (b) your failure to comply with the instructions or operate outside the parameters of use set forth in the user instructions provided together with the Products and Accessories; (c) contact with liquids, water, rain, extreme humidity or heavy perspiration, sand, dirt or the like, excessive heat or food; (d) use of Products or Accessories for abnormal use; or (e) other acts or omissions that are not the fault or negligence of Motorola or MDX Electronics, LLC. are excluded from coverage.

Use of Non-Motorola Branded Products

Defects or damage resulting from the use of Products not belonging to our brand, as well as any peripheral equipment, are excluded from the warranty.

Defects or damage resulting from repair, testing, adjustment, installation, maintenance, MDX Electronics, LLC, or its authorized service centers, are excluded from the warranty.

Altered products

Products or Accessories with (a) serial numbers or dated labels that have been removed, altered, or voided; (b) seals that are broken or show evidence of tampering; (c) mismatched serial numbers; or (d) non-Motorola-branded or non-suitable liners or parts are excluded from coverage.
